1. Acceptance of these terms
By creating an account or using Amber's App, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the app.
2. Eligibility & children
You must be at least 18 years old (an "adult") to create an account. Amber's App is used by children only through child profiles created and supervised by an adult in the household. By adding a child profile or a child's photo, you confirm you are that child's parent or legal guardian and consent to the processing described in our Privacy Policy.
3. Household accounts & roles
- A subscription creates one household account that supports up to two adults and up to five child profiles at launch.
- The account owner manages billing, buys extra credits, invites or removes the second parent, and may delete the household.
- An invited parent gets their own secure login, can create and read stories and manage child profiles, but cannot cancel the subscription or remove the owner.
- Each adult must use their own login. You are responsible for keeping your credentials secure and must not share passwords.
- Invitations are single-use, expire after 7 days, and can be revoked by the owner.
4. Subscription & billing
- The Amber's Family Plan is billed as a recurring monthly subscription at the price shown at purchase (for example US$9.99/month), plus any applicable taxes.
- Subscriptions auto-renew each month until cancelled.
- Purchases made through your device's app store are processed and managed under that store's terms, including renewal and refund handling.
- The plan includes 5 story credits per calendar month (reset on the 1st UTC); unused monthly credits do not roll over (see Story credits).
- Subscribers may purchase packs of 5 extra credits for $10.00 through the app.
5. Story credits
- Creating a story consumes one credit. Credits belong to the household and are shared by both parents.
- Monthly credits included with your plan are consumed first; separately purchased extra credits are consumed next.
- Purchased extra credits do not expire while your subscription remains active. If your subscription lapses, unused credits may be suspended until you resubscribe, as permitted by the app stores and law.
- Credits have no cash value and are not transferable outside your household.
6. Cancellation & refunds
The account owner may cancel at any time from account settings (or via the relevant app store). Your access continues until the end of the current billing period, after which it will not renew. Except where required by law or app-store policy, payments are non-refundable.
7. Your content
You and your household retain ownership of the ideas, photos, recordings and stories you create ("Your Content"). You grant us a limited licence to store, process and display Your Content solely to operate the service for you (for example, to generate, illustrate, narrate and save stories in your library). You are responsible for having the rights to any photo you upload.
8. Acceptable use
To keep Amber's App safe for children, you agree not to:
- upload photos of anyone without that person's (or their guardian's) consent;
- submit prompts intended to generate violent, sexual, hateful, harassing or otherwise harmful content;
- attempt to bypass child-safety filters or reverse-engineer the service;
- use the app for any unlawful purpose or to infringe others' rights;
- resell, or provide commercial access to, the service without our permission.
We may filter, block, remove content or suspend accounts that violate these rules.
9. AI-generated content
Stories and illustrations are generated automatically and are intended as playful, age-appropriate entertainment and reading practice. Generated content may occasionally be imperfect. You are responsible for reviewing stories for your child, and you can regenerate or delete any story you are not happy with.
10. Our intellectual property
The Amber's App name, logo, software, design and underlying technology are owned by us and protected by law. These terms do not grant you any right to use our branding except as necessary to use the app.
11. Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties. Nothing in these terms limits rights you have under mandatory consumer protection law, including the Australian Consumer Law where it applies.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability relating to the service is limited to the amount you paid in the 12 months before the claim.
13. Termination
You may stop using the app and delete your household account at any time. We may suspend or terminate access if you materially breach these terms or to protect users, subject to applicable law.
14. Changes to these terms
We may update these terms as the product changes. If changes are material, we will notify you in the app or by email. Continued use after changes take effect means you accept the updated terms.
